The New York State Department of Environmental Conservation (DEC) has released the Final Kushaqua Tract Conservation Easement Lands Recreational Management Plan (RMP) for motorized recreational use of snowmobiles, ATVs, and motor vehicles on the approximately 18,000-acre easement in the northern Adirondacks.

In its latest Recreational Management Plan for 19,000 acres near Rainbow Lake, the NYS Department of Environmental Conservation appears disinterested in biological information, much less in taking actions protective of sensitive biological resources.
The Kushaqua Conservation Easement is 19,000 acres of managed private timberland, formerly International Paper Lands, now Lyme Timber lands, located in the Towns of Brighton and Franklin. The tract lies north of Rainbow Lake and Buck Pond Campground, west of Loon Lake, east of Meacham Lake, and much of the tract is surrounded by Forest Preserve in the form of the Debar Mountain Wild Forest. The New York State Department of Conservation is seeking comments on their Recreational Management Plan (RMP) for the Kushaqua Tract Conservation Easement Lands in the northern Adirondack Park. The plan includes extensive development for motor vehicles, including more than 100 miles of roads to be used by cars and trucks, snowmobiles, and ATVs, and six new parking lots.
The NYS Department of Environmental Conservation (DEC) has opened new roads and facilities on nearly 25,000 acres of forest preserve and conservation easement lands in the Adirondacks.
New roads and facilities will allow motor vehicles to access the 18,000-acre Kushaqua Tract Conservation Easement Lands in Franklin County using the 3.3-mile Mountain Pond Road, and the 1,600-acre public use area of the Township 19 Tract Conservation Easement Lands in Hamilton County using the 2.6 miles of O’Neil Flow Road and Barker Pond Road. In the Essex Chain Lakes Complex gates have been opened to allow increased access to Camp Six Road in Newcomb, which will allow access for hunting, along with limited camping at designated primitive tent sites. » Continue Reading.
The NYS Department of Environmental Conservation (DEC) is proposing a new experiment trying to combine intensive public motorized recreational use and natural resource management. The DEC has released a draft Recreation Management Plan (RMP) for the Kushaqua Conservation Easement tract located in the Towns of Franklin and Brighton in Franklin County. Throughout this tract, the DEC is proposing to open a number of roads to all terrain vehicles (ATVs).
The DEC went down this road once before in the mid-1990s when they opened scores of roads on the Forest Preserve to ATVs. Though official processes were not followed at that time, scores of roads and trails throughout the western Adirondacks were opened to ATVs. Trespassing in other areas was also widespread across the Forest Preserve. After extensive damage to roads, trails, and natural resources, the DEC and APA backtracked in 2005 and closed scores of Forest Preserve roads to ATV use.

DEC purchased a working forest conservation easement on the lands in 2004 which includes development rights and sustainable forestry requirements. The New York State Board for Historic Preservation recommended the addition of 33 properties, resources and districts to the State and National Registers of Historic Places. Among the properties slated for inclusion are Northbrook Lodge on Osgood Pond near Paul Smiths in Brighton, NY and the John Losee House, in Watertown.
The State and National Registers are the official lists of buildings, structures, districts, landscapes, objects and sites significant in the history, architecture, archeology and culture of New York State and the nation. Said to be the the first parcel of land sold on Osgood Pond, Northbrook Lodge was built by renowned Great Camp builder Benjamin Muncil in the 1920s for Canadian Senator Wilfred L. The Adirondack Park Agency (APA) will hold its regularly scheduled monthly meeting on Thursday, February 10 at APA Headquarters in Ray Brook. The February meeting is one day only and will be webcast live. The meeting will be webcast live.
Among the issues to be considered is a boathouse variance, bridges and culverts in the Park, development in Queensbury and Westport, Green programs at the Golden Arrow Resort in Lake Placid, and a presentation on alpine meadow vegetation. Here is the full agenda:
The Full Agency will convene on Thursday morning at 9:00 for Executive Director Terry Martino’s report where she will present the 2010 annual report.
At 10:45 a.m., the Regulatory Programs Committee will consider a request for a shoreline structure setback variance to authorize the construction of stairs onto an existing boathouse. The project site is located on First Bisby Lake in the Town Webb, Herkimer County. Jim Bridges, Regional Design Engineer, and Tom Hoffman, Structure Engineer, from the NYS Department of Transportation will then brief the committee on the status of bridges and culverts inside the Adirondack Park.
At 1:00, the Full Agency will convene for the Community Spotlight presentation. This month Town of Brighton Supervisor John Quenell will discuss issues and opportunities facing this Franklin County town.
At 1:45, the Local Government Services Committee will consider approving an amendment to revise the Town of Queensbury’s existing zoning law. The committee will also hear a presentation from the Town of Westport to utilize a Planned Unit Development (PUD) in conjunction with a linked Agency map amendment process to establish growth areas within the town.
At 3:00, the Economic Affairs Committee will hear a presentation from Jenn Holderied-Webb from the Golden Arrow Lakeside Resort in Lake Placid on “green programs.” The Golden Arrow Resort implemented unique initiatives to establish itself as an environmentally friendly resort.
At 3:45, the State Land Committee will hear a presentation on alpine meadow vegetation.
At 4:15, the Full Agency will convene will assemble to take action as necessary and conclude with committee reports, public and member comment.

Of all the recent press about the State’s attempted sale of 92-acre former minimum security prison known as Camp Gabriels in the town of Brighton, nothing has yet been written about the small problem of the NYS Constitution which says that the lands of the state now owned or hereafter acquired, constituting the forest preserve, as now fixed by law…shall not be leased, sold or exchanged” (Article 14, Section 1).
Are the 92-acres of Camp Gabriels, in fact, Forest Preserve lands which the State unconstitutionally used for purposes of a minimum security prison? And, despite their developed condition, can the State now simply dispose of them like any other “surplus” property? » Continue Reading.
The DEC has announced the opening of limited public access for recreation to three parcels of conservation easement land formerly owned by International Paper Company and currently owned by Lyme Timber. The public will be able to access the lands for non-motorized recreation now; motorized access will be allowed in the future. The three parcels are the 17,125-acre Black Brook Tract in the Town of Black Brook, Clinton County; the 7,870-acre Altamont Tract in the Town of Tupper Lake, Franklin County; and the 19,000-acre Kushaqua Tract in the Towns of Brighton and Franklin, Franklin County. The parcels are part of one of New York State’s largest land conservation projects – 256,649 acres of land – which was announced on Earth Day in 2004.
The Black Brook, Altamont and Kushaqua Tracts had a five year waiting period before the properties could be opened to the public, which expired on April 22. The three tracts are open to public access for non-motorized recreation only- on foot, mountain bike, on horse, or canoe/kayak. According to the DEC “The full array of recreation rights purchased will not be available at this time due to lack of resources.” Currently permitted recreational activities include hiking, horseback riding, rock climbing, mountain biking, hunting, fishing, trapping, wildlife viewing and canoeing/kayaking. Camping and campfires are also prohibited until camp sites are designated.
Parking lots, trails, and trailheads, have not been buit and there is no signage yet. Trails for motorized recreation will be developed in the future following a planning process. Access to the property is by adjoining public highways and the DEC has asked that users avoid blocking any gates or obstructing traffic when parking.
These lands are privately owned and actively managed for timber. The landowner also leases private recreation camps. Lessees have the exclusive right to use one acre of land surrounding their camp which are not open to ANY public use or access. The one-acre camp parcels, however, may not block public access to or use of main access roads, trails, streams or ponds.
Visitors to these lands may encounter logging and construction equipment used in forest management and motorized vehicles, including ATVs, belonging to the landowner, their employees or camp lessees. The DEC asks that the public respect the rights of the landowner, camp lessees and their guests when using the property.
