Governor Andrew Cuomo has announced the latest phase of New York State’s acquisition of 69,000 acres, part of 161,000 acres of former Finch Pruyn lands (and others) purchased by the Nature Conservancy in 2007, as well as $875,000 in available grants for projects to develop tourism and recreation facilities within the Adirondack Park.
The State will pay $5.7 million to acquire the tracts from The Nature Conservancy (TNC), using the State’s Environmental Protection Fund (EPF) which is funded by real estate transfer taxes. Already, the state has completed two acquisitions from TNC totaling 30,037 acres. An additional 89,000 acres of the original TNC-Finch 161,00-acre purchase was set aside for logging and other motorized uses in 2010.
With this purchase New York State will add to the Forest Preserve 8,451 acres spread over 14 parcels in Fulton, Warren, Essex and Hamilton counties, along with a few parcels in Saratoga County that are outside the blue line. The Saratoga County properties include the Daniels Road tract (519 acres), the Penn York tract (241 acres) and the Town Line tract (176 acres). In addition, the Town of Edinburg will be able to move forward with the acquisition of 1,248 acres on Fox Hill Road. Given Governor Andrew Cuomo’s projected $2 billion surplus, his environmental agencies could have used a bit of a budgetary boost.
One can always hope. But readers already know this is not the case. Cuomo’s Environmental Conservation Commissioner, Joe Martens, made it explicit when he testified recently to legislative committees “Basically, this is a flat budget staff-wise,” he told legislators who politely questioned why his DEC budget appeared to be cut $43 million.
“Those dollars were non-reoccurring federal pass-through funds,” the commissioner answered. “Those are not cuts to our operating funds.” When questioned about the apparent loss of staff, the commissioner answered that those were DEC information technology personnel moved to a central IT office in Albany. » Continue Reading.
It’s state budget time, and the members of regional advisory committees on open space conservation from the Adirondacks to Niagara and Long Island will be watching that fraction of one percent of the state budget called the Environmental Protection Fund. Will the EPF continue to recover from the recessionary influenza it caught in 2009?
New York State’s extraordinary three million acre Forest Preserve in the Adirondack and Catskill Parks, and its extensive State Park and Historic area system (330,000 acres) outside of these Parks are two big reasons why the state has been a national leader in conserving forests and open space since the 19th century.
Another is nearly million acres conserved through the use of conservation easements on private lands. The EPF and spending from the 1996 $1.75 billion Clean Water/Air Bond Act (expended years ago) has funded this growth: 85% growth in conservation easements since 1992, 5% growth in the Forest Preserve during that time span. » Continue Reading.
The Adirondack Council urged state lawmakers to increase funding for environmental priorities in the FY2013-14 NYS Budget in testimony today at the legislature’s budget hearing. The Council cited the recent loss of a $2.5 million grant secured to aid the purchase of the Follensby Tract as a sign that New York’s Environmental Protection Fund (EPF) needs an expedited increase in funding.
Adirondack Council Legislative Director Scott Lorey called for an additional $11 million to be added in the EPF and also urged Governor Andrew Cuomo to rebuild the staffing at key regulatory agencies whose budgets have been cut in recent years, including the Department of Environmental Conservation (DEC) and the Adirondack Park Agency. » Continue Reading.
The Department of Environmental Conservation (DEC) and the Lake George Park Commission (LGPC) have announced they will take actions to prevent the spread and threat of aquatic invasive species in preparation for the summer 2013 Lake George boating season. In addition, an environmental review of a long-term plan to address invasive species is expected to begin shortly.
The announcement is the latest state and local action designed to reduce the spread of invasive species, particularly aquatic invasives. In 2011 Warren County passed a law making the introduction and transport of aquatic invasive species into Warren County waterbodies illegal. The state’s first county law of its kind imposes a fine of up to $5,000 and up to 15 days in jail for violators. In July 2012, Governor Andrew Cuomo signed the Invasive Species Prevention Act into law, directing DEC and the NYS Department of Agriculture and Markets to develop by September 2013 a proposed list of invasive species to be regulated and prohibited. » Continue Reading.
New York State has purchased 518 acres of land in northern Oneida County which will become the area’s newest state forest, New York State Department of Environmental Conservation Commissioner Joe Martens announced today. The acquisition in the Town of Forestport will protect almost a mile of Black River shoreline, just outside the Adirondack Park.
According to the press announcement, the state paid $385,400 for the land, which came from the Environmental Protection Fund. The property will be its own named state forest, as it is not adjacent to other state forests and will remain on local property tax rolls. The property is characterized by shady ravines with several springs that run year round, northern hardwood and coniferous forests, bogs with rare plants like pitcher plants and forested wetlands. The area is adjacent to conservation easement lands that protect the Town of Forestport water wells and will provide added protection for the Town’s water supply. » Continue Reading.
Conservation Partnership Program grants totaling $1.4 million were awarded to 53 nonprofit land trusts across the state according to a statement by the New York State Department of Environmental Conservation and the Land Trust Alliance. The grants, funded through New York State’s Environmental Protection Fund (EPF), will be matched by a total of $1.2 million in private and local funding.
The purpose of the grants is to increase the pace, improve the quality and ensure the permanence of voluntary conservation of private lands, which is expected to result in environmental and economic benefits for communities throughout New York. » Continue Reading.
New York’s Environmental Protection Fund (EPF) supports industries that generate approximately $40 billion annually for the State’s economy and sustain hundreds of thousands of jobs, according to a recent analysis.
The report, prepared by The Trust for Public Land (a national conservation organization) in collaboration with the New York Environmental Leaders Group, concludes that the EPF generates jobs, supports local economies, and elevates property values. The analysis also concludes that for every $1 invested to protect lands under EPF, $7 in economic benefits is returned to New York through “natural goods and services,” such as filtering air and water of pollutants, and flood control. » Continue Reading.
Adirondack backcountry users and the state’s natural resources will both receive a higher level of protection following the creation of a Backcountry Stewards Internship Program, a new partnership between New York State Department of Environmental Conservation (DEC) and the Student Conservation Association (SCA), and the reinstatement of the Assistant Forest Ranger program. The Backcountry Stewardship Program expands on a long-running partnership between SCA and DEC that began more than a decade ago in the Hudson River Valley and the Adirondacks. With the New York State Legislature wrapping up another session, I thought it would be a good idea to take a look at some of the bills making their way through the process. This list is not complete, but contains those items that are important in one way or another to the Adirondack Park.
There are two online systems that provide information about latest legislative actions and the status of bills. The NYS Senate’s Open Legislation system is still in Beta, but is apparently up to date, includes the latest Assembly info as well, and has the easiest user interface. The older system, the Legislative Research Service system, claims to offer “up to the minute” information.
Prohibiting NYS From Purchasing Land for Forest Preserve Betty Little’s bill to prohibit the state from purchasing forest land in fee title and to only allow purchases by conservation easement. Killed just after 4 p.m. today in the Senate Rules Committee, a final stop on the way to a floor vote. (S. 1501 Little)
National Grid Land Exchange This legislation will complete the Constitutional Amendment authorizing land swap that was approved by voters in 2009, allowing the New York Power Authority and National Grid to complete the Route 56 Tri-Lakes power line project. In exchange for receiving six acres of State Forest Preserve, National Grid is buying and giving to the public 20 acres that will be included in the Adirondack Forest Preserve. EPF Revenue Enhancer This bill would, over the next four years, add the unclaimed nickel deposits from “bottle bill” revenues as an additional source of money for the Environmental Protection Fund (EPF). The EPF provides grants for land acquisition, invasive species control, smart growth projects and water quality improvements. Boat Launch Preservation Act Requires that one percent of the 4 cents per gallon gasoline surcharge on gasoline which is used on waterways but not more than 5 million dollars per fiscal year is to be deposited in the dedicated boat launch site fund; moneys of such fund shall be disbursed for design, construction, maintenance and improvement of boat launches and boat access sites. Requiring Large Water Withdrawal Permits Would grant DEC permitting abilities for withdrawals of large amounts of water (over 100,000 gallons per day) from lakes, rivers, streams or underground sources. Commemorate Adirondack Medical Center 100th What is known today as the Adirondack Medical Center began as two separate hospitals, the General Hospital of Saranac Lake, and the Placid Memorial Hospital of Lake Placid. Built at the top of Winona Avenue, the General Hospital of Saranac Lake was founded in 1911; The Placid Memorial Hospital Fund, was organized in 1947, and plans for construction of a new hospital to be located on a Church Street parcel were developed. Repeals Defunct Water Quality Compacts Repeals the Champlain Basin Compact, the Mid-Atlantic States Air Pollution Control Compact and the Delaware River Basin Water Commission Compact. To clean up and clarify the Environmental Conservation Law by repealing certain outdated sections which relate to proposed interstate compacts that were never established. What follows is a guest essay from Minerva carpenter Duane Ricketson, an original appointee to the Department of Environmental Conservation’s (DEC) Region 5 Open Space Advisory Committee in 1990 and one of the longest serving state appointees. He’s an Adirondack native whose family arrived in the region in the 1790s and who enjoys fishing, hunting, hiking and camping. Ricketson supported and worked with local leaders on the Region 5 Open Space Advisory Committee to get local governments and Adirondackers enfranchised in the process of open space protection, especially the local government veto, which he now sees as being usurped by the Local Government Review Board.
On the surface, the recent drive by Adirondack politicians and local media to stop the State from purchasing the former Finch-Pruyn lands from the Adirondack Chapter of the Nature Conservancy is simply a continuation of the storied battle between Adirondackers and the State of New York over buying land in the Adirondack Park. This time it opens a brand new chapter, however, because the actions of local governments are now being called into question by The Local Government Review Board. » Continue Reading.
Here are some of the Adirondack Park related highlights from Governor Andrew Cuomo’s 2011-12 Executive Budget, his first plan for closing the state’s estimated $11 billion deficit.
Cuomo’s budget plan would maintain the state’s Environmental Protection Fund (EPF) at $134 million, the same spending level as in the current budget, but would further reduce the budgets of the Adirondack Park Agency, the Department of Environmental Conservation, close several prisons (possibly including some in the North Country), and disband the Tug Hill Commission. “We have to consider this a victory,” said Neil Woodworth, executive director of the Adirondack Mountain Club (ADK) said in a statement about EPF funding. “Under the circumstances, it could have been much worse. Deep cuts in the EPF would have had a substantial and long-lasting impact on New York’s natural resources. Fortunately, Governor Cuomo had the wisdom and foresight not to do that.” » Continue Reading.
The Nature Conservancy has announced what it calls “a historic land agreement with New York State that supports timber industry jobs, boosts the State’s recreation and tourism economy and, at the same time, preserves 89,000 forested acres concentrated in the geographic heart of the Adirondacks.” The agreement transfers a conservation easement of commercial working forest in the Adirondacks once owned by Finch, Pruyn to New York State.
New York State paid $30 million for the conservation easement, which includes specific recreation rights to the land, with money allocated for this purpose in last year’s Environmental Protection Fund (EPF). Twenty seven local towns where the properties lie have all approved the purchase which secures new public access to lands and waterways, including permanent snowmobile trails. The easement opens key access to the approaches to the Santanoni Range, Allen Mountain and the Hanging Spear Falls. » Continue Reading.
On Earth Day 1970, people around the country, mostly college students, demonstrated on behalf of environmental causes. Forty years later, the environmental movement has come into the mainstream and secured state and federal agency leadership positions. More importantly, the movement has significantly improved the quality of our rivers, lakes and forests and in doing so has provided for the proliferation of local wildlife. While there are certainly challenges that remain – invasive species, inappropriate development, toxic exposures, nitrate and storm water management, climate change, the plight of amphibians, migratory birds, and bats – the environmental successes of the last 40 years should not be underestimated. By and large, the first Earth Day was much like those that have followed: politicians, celebrities, concerts, environmental fairs, and the like. But Earth Day 1970 was a radical proposition in a time before the Environmental Protection Agency (EPA) was founded, and before there were state sanctioned bodies like the Department of Environmental Conservation (DEC) to protect the environment. At Boston’s Logan Airport, where a few hundred demonstrators had gathered in what a CBS reporter called a “thoroughly peaceful and non-disruptive demonstration”, police charged the crowd and arrested 13.
In the 40 years since that first Earth Day the Adirondack region has seen a revolution in the way we interact with our environment. Sure, we can point to the founding of DEC (1970), the establishment of the EPA (1971), the Clean Air Act (1970), and the Clean Water Act (1972), State Environmental Quality Review Act (1980), the Superfund Law (1980), and the Environmental Protection Fund (1993) but there has been a leadership revolution as well. Today, Pete Grannis, who was part of the first Earth Day demonstrations, is now the head of the DEC. Judith Enck, the state’s leading environmental activist in the 1980s, is now the Administrator of EPA’s Region 2.
Changes in the natural environment have been extraordinary. The Hudson River, once an open sewer where no one dared to boat, never-mind swim or fish, now bustles with recreation activities in summer. According to the DEC, the number of seriously polluted waters in the state has fallen by 85% and Sulfur Dioxide pollution is down by 90%, with a corresponding improvement in Acid Rain.
Successes we don’t typically consider include the closure of outdated and poorly located landfills (more than 100 in Adirondacks alone), the elimination of the tire dumps (including more than 27 million tires statewide), the cleaning up of Superfund and brownfield sites (1,800 statewide) and the thousands of water bodies large and small around the state that have been cleaned-up in the last 40 years through waste-water management.
We may not consider those victories as much as we should, but local wildlife certainly has. In 1970 there was just one occupied Bald Eagle nest in New York State, in 2010 there are 173. Eagles and other raptors we rarely saw in the 1970s and 1980s, birds like the peregrine falcon, are now fairly frequent sights; ravens and osprey have returned to the Adirondacks. Wild turkeys have exploded from about 25,000 in 2010 to 275,000 today, and so turkey hunting has returned to the Adirondacks. Native trout have been returned to more than 50 ponds according to the DEC, and the average number of fish species has increased by a third offering increased angling opportunities. Beaver, fisher, and otter have flourished in cleaner, more diverse waters and so trapping seasons have returned for those species. In 1970 there were no Moose in the Adirondacks, today there are 400 to 500 in the region.
Clean water, clean air, and open spaces were the demands at the first Earth Day in 1970. Those demands were met by legions of combative corporations, industry alliances, business groups, chambers of commerce and their attorneys. A look at a local paper on any given day shows that those battles continue, but 40 years has shown that the environmental movement has been an enormous success. Despite the attacks and “enviro-nazi” insults, the former hippies, political greens, organization environmentalists, and wildlife conservationists who have made up the environmental movement have much to be proud of.
NYS Comptroller Thomas DiNapoli released a report late last week that argues for the economic benefits of open space conservation [pdf]. According to John Sheehan of the Adirondack Council, “this is the first attempt ever by the state’s top elected financial officer to quantify the value of undeveloped forests and open farm lands.”
The report comes at a time when the Legislature is negotiating the 2010-11 state budget, including the Environmental Protection Fund and its Open Space Account. This year’s budget contains $212 million for the EPF and $59 million for open space protection — land acquisition and conservation easements (purchase of development and recreational rights on private lands). The Senate has proposed a $222-million EPF for the fiscal year that begins April 1, with little detail yet available on specific categories. The Assembly yesterday proposed an EPF of $168 million, with $44.3 million for land. The Governor — whose proposal came out first, back January, had proposed a $143-million EPF, with zero for land.
“Open space can provide a variety of public benefits, including storm water drainage and water management,” DiNapoli said. “Open spaces also provide a more direct economic benefit through tourism, agriculture and the forestry industry. All these benefits should be a factor in land use decisions from Montauk to Massena.” Here is an excerpt from Dinapoli’s press release on the report:
Agriculture is among New York’s largest and most vital industries, encompassing 25 percent of the state’s land and generating more than $4.5 billion for the state’s economy each year. In 2007, the income generated directly by farms, combined with income generated by agricultural support industries and by industries that process agricultural products, totaled $31.2 billion.
The study noted that open space contributes to the state’s economy by providing opportunities for outdoor recreational activities. DiNapoli also noted that open space often requires fewer municipal services than lands in other use and tend to generate more in municipal tax revenue.
Open space helps control storm water runoff, preserves surface water quality and stream flows, and aids in the infiltration of surface water to replenish aquifers. When lands are converted to other uses, the natural benefits provided by open space often must be replaced through the construction of water treatment facilities and infrastructure to control storm water, all paid for through local tax revenue. A series of studies have found the preservation of open space to be a more economical way to address storm water requirements.
DiNapoli’s report recommends that New York State consider:
* Allowing municipalities to establish community preservation funds * Evaluating the adequacy of protections for lands providing benefits for municipalities * Improving state-level planning for open space to address long-term funding needs * Improving the administration of funds for open space programs * Encouraging private land conservation
