‘Miss Lonelyhearts’ Woods Being Protected

view from huckleberry mountain forestJohn Sanford, the writer who placed a series of novels and stories in Warrensburg, once recalled, “In the spring of 1931, when Nathanael West was writing his second novel, Miss Lonelyhearts, I was working on my first. Neither of us was progressing… and when West proposed that we get away from the city, I turned up the right place to go. I’d met an upstate game warden, and through him, we obtained, for $25 a month, a seven-room cabin in the Adirondacks, together with a forest preserve of 1,200 acres and a 50-acre pond – Viele Pond, it was called. There in that private realm, we wrote, fished, swam and shot away the summer.”

PROTECT Advocates for 36,500 Acres of New Wilderness Lands

Boreas Ponds Dam aerial photo by Carl HeilmanProtect the Adirondacks has released a proposal to expand Wilderness areas in the Adirondack Park by over 36,500 acres. This includes Wilderness classification for much of The Nature Conservancy/former Finch, Pruyn and Company lands that border the High Peaks Wilderness and the creation of a new West Stony Creek Wilderness area in the southern Adirondacks.

This would be the biggest expansion of Wilderness in the Adirondacks since Governor Pataki acted in 2000 to establish the 20,000-acre William C. Whitney Wilderness area, which included upgrading of the 7,500-acre Lake Lila Primitive Area to Wilderness, and expanded both the Five Ponds Wilderness and Pepperbox Wilderness by over 21,000 acres.

Ours is a realistic proposal that provides Wilderness classification and protection for the most important natural resource areas of the land involved. It also aims to facilitate motorized access for limited roads open to the public and snowmobiles. We make a good faith effort at providing a workable and realistic classification and management that complies with the law, protects natural resources, and meets the objectives of many different interests. » Continue Reading.

Legal Questions Swirl Around State’s Plan For Essex Chain

Polaris Bridge and the Upper Hudson (courtesy Protect the Adirodnacks)Two of the Adirondack Park’s four major environmental organizations filed a legal challenge to the Essex Chain management plan, but the two others have legal questions as well.

Protect the Adirondacks and Adirondack Wild filed a lawsuit today in State Supreme Court in Albany, claiming the management plan violates the Adirondack Park State Land Master Plan, the state Wild, Scenic, and Recreational Rivers Act, and state snowmobile-trail policy.

Named as defendants are the state Department of Environmental Conservation, which drafted the management plan, and the Adirondack Park Agency, which approved it. Both agencies refused to comment on the suit.

Christopher Amato, a former assistant commissioner at DEC, told the Almanack that the Essex Chain plan is “blatantly illegal.” Amato is now an attorney at Earthjustice, a nonprofit organization that is representing Protect and Adirondack Wild in the lawsuit.

Amato said Earthjustice will file a motion to prevent DEC from implementing the management plan until the lawsuit is resolved.

Gibson: APA’s Legal Fiction To Motorize Forest Preserve

Dan at APA (2)I wish to recognize Adirondack Park Agency board member Art Lussi for his insistence over the past several months that the NYS Department of Environmental Conservation (DEC) provide a legal rationale for allowing expanded motorized uses in the Forest Preserve’s protected river corridors. When DEC failed again last week to provide that legal explanation, Lussi joined Richard Booth in voting no on DEC’s plans for the Essex Chain area because they fail to comply with the State Land Master Plan. » Continue Reading.

APA Approves Controversial Essex Chain Plan

Polaris Bridge over the Hudson River (Linda McIntyre Photo)The Adirondack Park Agency board voted 8-2 Friday to approve a management plan for the Essex Chain Lakes region that one of the dissenters denounced for its “legal fiction.”

One of the major controversies is over the decision to retain an iron bridge over the Hudson River for use as a future snowmobile trail.

The Hudson in that area is classified as a Scenic River, a designation that normally precludes motorized uses and large bridges. The state Department of Environmental Conservation, however, contends that motorized use over the river predated the law and thus can continue.

Essex Chain Lakes Management Comments Sought

Full Essex Chain MapThe Adirondack Park Agency (APA) is accepting public comments on how their Essex Chain Lakes Complex Plan conforms to the Adirondack Park State Land Master Plan. The comment period will conclude on October 16, 2015.

The plan addresses the continued development of controversial bicycling and snowmobiling projects, including the construction of a bridge over the Cedar River continued maintenance of the Polaris (Iron) Bridge over the Hudson River, and the construction of a new snowmobile trail between Indian Lake and Minerva. » Continue Reading.

High Peaks Oil Trains: A Primer On The Issues

Iowa Pacific oil trainsThe Iowa-Pacific rail company took state officials and environmental activists by surprise in July when it unveiled a plan to store hundreds of drained oil-tanker cars on its tracks near Tahawus on the edge of the High Peaks Wilderness.

Ed Ellis, the president of Iowa Pacific, says revenue from storing the cars will help keep afloat its tourist train, the Saratoga & North Creek Railway, which has been losing money. Critics contend Iowa Pacific is creating a quasi-junkyard in the Adirondack Park. » Continue Reading.

Railroad Plans To Store Oil Tankers in High Peaks

Last week, company President Ed Ellis made a presentation to the Warren County Board of Supervisors Public Works Committee about the company’s new plans. Polaris Bridge in beautiful flat water stretch of the Hudson River.The Polaris Bridge over the Hudson River should be removed by the Department of Environmental Conservation (DEC) and the river restored at the crossing.

The bridge spans the beautiful Blackwell Stillwater stretch of the Hudson, one of the most picturesque spots in the Adirondack Park. The Goodnow River enters the Hudson just above the bridge.

DEC’s 11th Hour Forest Preserve Plans Criticized

It’s the second time in as many months that APA members felt unprepared.

In May, APA Member Richard Booth spoke of having to review 80 pages and 45 maps of alternative snowmobile trails through the Forest Preserve just a few days before his State Land Committee was expected to consider them in public. This month, APA Member Art Lussi  said he had less than 24 hours to review the 141-page Essex Chain of Lakes Complex Draft Unit Management Plan (UMP), which includes more than 20 maps before the Committee’s most recent meeting. “I have to comment that these plans are thrown at us in a way that doesn’t allow for us to give you input,” Mr. Lussi said to Rob Davies of the DEC. » Continue Reading.

DEC Seeks Major Backcountry Development Of Essex Chain

Essex Chain MapA draft plan for the Essex Chain Lakes Complex produced by the NYS Department of Environmental Conservation (DEC) calls for major back-country development in some of the most unique lands in the Adirondack Park, only recently acquired by the people of New York.

The plan for the Essex Chain Lakes Complex, located in the towns of Minerva, Newcomb, and Indian Lake, includes a snowmobile trail that would cross the Hudson River on the Polaris Bridge and the Cedar River on a newly constructed bridge; extensive mountain biking and equestrian trail networks; new ski trails, carry trails, and lean-tos; and expanded road access and parking areas. Dave Gibson: Consider Big Policy Issues Early, Openly

MRP-Snowmobile-Trail-3Not quite twenty years ago, Governor George Pataki’s administration made some decisions about snowmobiling on the Adirondack Forest Preserve which are still playing themselves out today. Governor Pataki’s first DEC Commissioner, Michael Zagata, signaled in 1995-96 that he would support a minimum of 15-foot wide routes (roads) for snowmobiling, cleared in order to accommodate 52 inch sleds and two-way travel. A hue and cry erupted and Commissioner Zagata did not survive in the job past 1996. The cleared width standard remained 8 foot, 12 foot for sharp curves. However, two years later in 1998 the Governor recommitted to new snowmobiling initiatives in the Adirondack Park as a way to balance, in the Governor’s view, the State’s acquisition of Whitney Park in Long Lake for the Forest Preserve. » Continue Reading.

Willie Janeway On APA’s Snowmobile Trail Reversal

iron bridgeAt the Adirondack Park Agency (APA) on Thursday, the State Lands Committee approved sending to the full Board a recommendation that proposed Community Connector Trail Plan Unit Management Plan (UMP) amendments should go to public comment. The plan favored a multi-use trail plan that included a series of new connector snowmobile trail segments. This recommendation was approved 3-1 over strenuous objections raised by the Committee Chairman Richard Booth.

On Friday, in response to concerns raised by the Adirondack Council and others, the APA commissioners voted unanimously to send to public review a proposed final plan that didn’t include a controversial trail segment that crossed the Hudson River at the Polaris Bridge. » Continue Reading.
